Consumer Wins Jury Verdict in Spot Delivery Case

On November 3, 2023, a federal jury in the Eastern District of Michigan rendered its verdict for more that $350,000.00 against Suburban Ann Arbor, LLC or its part in a spot delivery scam.  The jury deliberated throughout the afternoon before finding the dealership liable for $15,000 in actual damages along with $350,000.00 in punitive damages.  The Court is currently considering additional damages under Michigan's conversion statute and the Michigan Regulation of Collection Practices Act.  Those damages could bring the final judgment close to $500,000.00. 

During the trial, the jury heard testimony from the Secretary of State's representative establishing that in the state of Michigan, the practice of "spot delivery" or "yo-yo" scams are illegal under both Michigan's motor vehicle laws and the laws covering the financing of motor vehicles.  The dealership confirmed in its testimony that it had sold a car to the consumer on credit even though it had not received any approval from a finance company, and then repossessed the vehicle, even though the consumer had attempted to make payments.  The jury also hear from a past victim who had also been sold a car on credit, only to have it repossessed.  Ultimately, the dealership confirmed that it had kept the consumer's down payment and refused to accepted the consumer's monthly payments.
